Terms of Service

These Terms of Service (“Terms”) govern your access to and use of offpress.dev and our related services (the “Service”), operated by OffPress (“OffPress,” “we,” “us,” or “our”). By using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

OffPress scans a website you provide, rebuilds it as a modern website using automated and AI-assisted tools, and can host and let you edit that site. Features, credits, and pricing may change as the Service evolves. We may add, modify, or discontinue parts of the Service.

2. Your account

You must provide an accurate email address and keep your account secure. You are responsible for activity that happens under your account. You must be at least 16 years old (or the age of majority where you live) to use the Service. Sign-in links are personal to you — do not share them.

3. Your content and rights

You represent and warrant that you own, or have all necessary rights to, any website, content, domain, or materials you submit to the Service, and that migrating and reproducing them through OffPress does not infringe anyone's rights or violate any law. You retain ownership of your content and your rebuilt site. You grant us a limited licence to host, copy, process, and display your content solely to operate and provide the Service to you.

4. Acceptable use

You agree not to use the Service to:

• Migrate or host content you do not have the right to use, or that infringes intellectual property or privacy rights.
• Publish unlawful, harmful, deceptive, hateful, or abusive content, or content that violates others' rights.
• Attempt to disrupt, reverse-engineer, overload, or gain unauthorised access to the Service or its infrastructure.
• Scan or process sites you have no relationship with for the purpose of misappropriating their content.
• Resell or misuse the Service in ways not permitted by these Terms.

We may suspend or terminate accounts that violate this section.

5. Credits, plans, and billing

• Credits are the unit used for AI actions such as edits and additional builds. New accounts receive a starter credit grant. Scanning and the instant preview are free.
• Plans are billed in advance on a recurring basis through our payment processor (Stripe) and include a monthly credit allowance and site limit. Hosting is covered by your plan and does not consume credits.
• Top-up packs are one-time credit purchases.
• Unless required by law or stated otherwise, payments are non-refundable, and credits have no cash value. You can cancel a subscription at any time; it remains active through the end of the paid period.
• Prices may change; we will give notice of material changes before they affect you.

6. AI-generated results

OffPress uses automated and AI-assisted tools to rebuild and edit sites. While we strive for faithful, high-quality results, automated output can contain errors or imperfections. You are responsible for reviewing your site before publishing it or pointing your domain at it. The Service is provided to assist you, not to replace your own review and judgement.

7. Third-party services

The Service relies on third parties (including hosting providers, Stripe for payments, Elastic Email for email, and AI providers such as Anthropic). Your use of the Service may be subject to their terms, and we are not responsible for their acts or omissions.

8. Intellectual property

The Service itself — including our software, design, and branding — is owned by OffPress and protected by law. These Terms do not grant you any rights in our intellectual property except the limited right to use the Service as described here.

9. Disclaimers

The Service is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including fitness for a particular purpose, merchantability, non-infringement, and uninterrupted or error-free operation. We do not warrant that migrations will be perfect or that search rankings will be maintained.

10. Limitation of liability

To the fullest extent permitted by law, OffPress will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, revenue, profits, or goodwill, arising from your use of the Service. Our total liability for any claim relating to the Service will not exceed the amount you paid us in the three months before the event giving rise to the claim.

11. Indemnity

You agree to indemnify and hold OffPress harmless from claims, damages, and expenses (including reasonable legal fees) arising from your content, your use of the Service, or your violation of these Terms or the rights of others.

12. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you breach these Terms or if necessary to protect the Service or other users. On termination, your right to use the Service ends; sections that by their nature should survive (such as ownership, disclaimers, and limitations of liability) will survive.

13. Governing law

These Terms are governed by the laws of the Province of British Columbia and the federal laws of Canada applicable there, without regard to conflict-of-laws rules. You agree to the exclusive jurisdiction of the courts located in British Columbia, Canada for any dispute that is not subject to arbitration or small-claims resolution.

14. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will update the date above and, where appropriate, notify you. Your continued use of the Service after changes take effect means you accept the updated Terms.
